By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the website or make a purchase.

1. Governing Law & Jurisdiction- These Terms shall be governed, construed, and enforced in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any legal action, suit, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the state or federal courts located in Colorado.

2. Handmade Product Disclaimers & Variations- Because our pottery is uniquely handcrafted, you acknowledge and agree to the following: Natural Variations: Every piece from Kyndal's Clay Creations is made by hand. Slight variations in size, shape, glaze color, texture, and markings are a natural characteristic of handmade ceramics and are not considered defects.

• Product Images: We make every effort to display the colors and details of our products accurately on the Site. However, we cannot guarantee that your computer monitor or mobile device will display the colors perfectly.

• Safety & Care: Unless explicitly stated otherwise in the product description, our functional pottery is food-safe. We will provide care instructions (such as microwave or dishwasher safety) on the product page, but we are not liable for damage caused by improper use or thermal shock (sudden temperature changes).

3. Purchases, Pricing, and Payments- Billing Information: If you wish to purchase any product made available through the Site, you may be asked to supply certain relevant information, including your credit card number, expiration date, billing address, and shipping details.

• Price Changes: We reserve the right to change our prices for products displayed on the Site at any time without notice.

• Order Rejection: We reserve the right to refuse or cancel any order at our sole discretion, including due to product unavailability, errors in product descriptions or pricing, or suspected fraud.

4. Final Sales & No Returns- As stated in our Return Policy, all sales are sold as is and final. We do not accept returns, refunds, exchanges, or cancellations once an order is placed. For items damaged during transit, please refer to our damage reporting guidelines.

5. Shipping & Delivery- We are not responsible for delays, lost packages, or theft caused by the shipping carrier once the package leaves our hands. Buyers are responsible for providing the correct shipping address. We cannot refund or replace orders sent to an incorrect address provided by the customer.

6. Intellectual Property- All designs, product names, photos, and content on our platform are the intellectual property of Kyndal's Clay Creations. You may not replicate, resell, or use our content for commercial purposes without explicit written permission.

7. Changes to Terms- We reserve the right to update or change these Terms of Service at any time without prior notice. Your continued use of our services constitutes acceptance of those changes.

8. Limitation of Liability- To the maximum extent permitted by applicable Colorado law, Kyndal's Clay Creations shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Site or products purchased.

Note: We do not store or see your credit card or payment information. All payments are processed securely through our third-party payment processors (like Shopify, Stripe, PayPal, or Square, etc.).

Return/Damage Policy 

Our items are unique, handmade, or custom-made, all sales are sold as is and are final. We do not accept returns, exchanges, or cancellations once an order has been placed. Replacements are only issued for items damaged in transit. We cannot replace or refund items broken during regular use, handling or washing. 

Damaged or Incorrect Items- We take great care in packaging your items so they arrive safely. However, if your order arrives damaged during transit or if you receive the wrong item, please reach out to us immediately so we can make it right. Contact us within 3 days of delivery at kyndalsclaycreations@gmail.com. Include your order number and a clear photo of the damaged or incorrect item.
